The wali: why a woman does not conclude her own marriage

The question comes up constantly, and it is usually framed wrongly. It is presented as a question of freedom. Sheikh Salih al-Fawzan puts it back where it belongs in his first sentence: it is a question of fiqh.

A condition of validity

A marriage is only valid under certain conditions. The wali is one of them, and it is he who concludes the contract.

The text is this: there is no marriage without a wali and an upright witness.

Sheikh al-Fawzan draws the consequence: a woman does not conclude her own marriage, her wali concludes it. If she concludes it alone, her contract is defective and not valid. He specifies that this is the position of the majority of the people of knowledge.

So this is not a cultural custom, nor an optional precaution. It is a condition of validity: without it, there is no contract.

Who the wali is

The wali is the nearest relative on the paternal side. The father first, then, depending on the situation, the paternal grandfather, the brother, the paternal uncle.

An important note for convert sisters, or those whose family is not Muslim: the question of the wali is then posed differently, and it must be put to a person of knowledge rather than settled alone.

What the wali has no right to do

This is the counterweight, and it is as firm as the rule itself. Sheikh al-Fawzan recalls that Allah has forbidden adl.

Adl means that the wali prevents the woman in his charge from marrying a suitable man whom she has accepted.

The sheikh insists on the double condition, and the order of his phrasing is useful: it is not enough that she accepts him, he must also be suitable. Both are necessary. Compatibility is indispensable.

In other words, guardianship is a protection, not an arbitrary veto. A wali who refuses a suitable suitor, accepted by the woman in his charge, without valid grounds, commits a named prohibition.

Consent, the other condition

The same sheikh is just as clear on the other side: marriage is founded on agreement, consent and shared life, and the consent of both spouses is a condition of validity of the contract. We devote a separate article to it.

Wali and consent are therefore not opposed. They are the two conditions of a single contract.

How this works on Nikah

A sister registers her wali at sign-up. He can follow the introduction from the first message without creating an account: he receives a dedicated link. For the video mouqabalah he joins the interview through that same link, and the meeting is held with three participants.

This is not an option to switch on afterwards. It is the default, because the wali is not an option in the contract.
