Law Enforcement Protocol

Procedure for handling judicial requisitions and legal requests addressed to Nikah.

This page is intended exclusively for judicial authorities and law enforcement (police, gendarmerie, magistrates) as well as their competent foreign counterparts. It describes the procedure for sending Nikah a judicial requisition (réquisition) or a request for access to data in the context of an investigation. Nikah cooperates with the authorities within the limits permitted by law and with respect for its members' rights.

1. How to submit a request

Any judicial requisition or legal request must be sent in writing, on the official letterhead of the requesting authority, to the following address:

Anonymous or incomplete requests, or requests not originating from an authorised authority, cannot be processed.

2. Information to provide

To allow prompt and compliant processing, your request must specify:

  • The requesting authority and the identity of the officer or magistrate in charge
  • The legal basis of the request (reference of the proceedings, case file or decision)
  • The precise identifiers of the targeted account: email address, profile identifier or profile URL, and where applicable an IP address with date and time (time zone)
  • The exact nature of the data requested and the period concerned
  • An official contact (institutional email, phone) for the reply
  • Where applicable, the legal deadline or the confidential nature of the request

3. Applicable legal framework

Nikah discloses data only on the basis of a legally valid request:

  • French authorities: judicial or administrative requisitions provided for by the French Code of Criminal Procedure (in particular articles 60-1, 60-2, 77-1-1, 77-1-2 and 99-3) or any other decision of a competent authority.
  • Foreign authorities: requests must go through international mutual legal assistance channels (MLAT, international letters rogatory) or be compatible with applicable law. The data is hosted with Google Cloud / Firebase (see the legal notice).

Nikah reserves the right to challenge a request, to ask for clarification, or to refuse a request that is manifestly unfounded, disproportionate or not compliant with the law.

4. Data that may be disclosed

Within the limits of what we actually retain (see our privacy policy), the data that may be disclosed is:

  • Registration data: surname, first name, email, account creation date
  • Connection data: IP addresses and logs, within the limits of their retention period
  • Profile data: information provided by the member
  • Conversations: kept for 12 months after the last activity
  • Identity document: deleted after validation (30 days at most), and therefore rarely available

Some data may no longer exist at the time of the request because of our retention periods. To prevent its deletion, send a preservation request (section 6).

5. Payment data

Payments are processed by our provider Stripe. Nikah does not store any bank card data. Requests concerning transaction or payment data must be addressed directly to Stripe through its dedicated channels for authorities.

6. Preservation request (data freeze)

If formal proceedings are underway or imminent, you may send us a preservation request so that we freeze an account's data before its deletion. Specify the identifiers concerned and the desired duration. In the absence of a formal requisition within a reasonable time, the data resumes its normal retention cycle.

7. Emergency requests (imminent danger)

In the event of a serious and imminent danger to a person's life or physical integrity, include the wording "URGENCE – PÉRIL IMMINENT" (EMERGENCY – IMMINENT DANGER) in the subject line of your message.

In that context, and in good faith, Nikah may disclose without delay the information strictly necessary to prevent the danger, in accordance with the law. An emergency request remains limited to the situation described.

8. User notification

Unless prohibited by law, bound by a confidentiality obligation (for example the secrecy of an investigation) or where there is a risk to a person's safety or to the integrity of the investigation, Nikah may inform the member concerned that a request targeting their data has been received. If the disclosure must not be notified, state so expressly and specify the legal basis.

9. Timeframes and costs

We process valid requests as promptly as possible and according to their degree of urgency. Manifestly excessive or repetitive requests may give rise to reasonable costs or to a reasoned refusal, in accordance with the applicable regulations.
