Halal marriage

Halal marriage, in practice

The word "halal" has become a commercial label. It refers to something precise, however: a contract whose conditions of validity are known, and without which there is no marriage at all.

What "halal" actually refers to

A marriage is not halal because a platform says so. It is halal because its contract meets conditions the people of knowledge set out precisely, and which depend on no provider.

The consequence is direct: no website, including this one, can make a marriage valid. What a website can do is avoid pulling you away from it. That alone is rare.

What you cannot do without

The wali. The woman's guardian concludes the contract. This is not a cultural formality nor a family courtesy: it is a condition of validity. A woman who marries without her guardian performs an act the majority of the people of knowledge declare void.

Two witnesses. The contract is public by nature. This requirement is precisely what separates marriage from a discreet arrangement between two people.

The consent of both spouses. An imposed marriage is not a marriage. Consent must be real, and it must be possible to withdraw it without anyone having to justify themselves.

The dowry. It is a right of the wife. Fatwa no. 14950 calls it indispensable without counting it among the pillars of marriage or among its conditions: a contract in which it was not named remains valid, and the dowry of her peers is then owed to the wife. It is neither a price nor a display of status.

What makes these processes fail

Escalating dowries stop marriages. Fatwa no. 12097 warns against overburdening in terms of consequences, not preferences: it may keep people from marrying, and may leave young men and young women unmarried. What we observe beyond that is our own: projects abandoned, and a generation for whom marriage becomes a synonym for debt.

Prolonged exchanges without a framework stop others. Months of private conversation, with no informed guardian and no horizon, produce attachment but rarely a contract.

Finally, collecting contacts. Running five conversations in parallel does not increase the chances of marrying: it postpones the decision, indefinitely.

What makes the contract valid does not depend on the place

On the place, fatwa no. 15986 imposes none. It names several without settling on one: at the ma'dhoun, at the judge, in the wali's house, in the husband's house, or in any place at all. What the Shaykh holds to is what must happen there: that the two spouses be free of impediments, that it be done by the offer and the acceptance, in the presence of two upright witnesses.

The timing gets the same answer: the contract is permitted at any time, even long before the wedding, even long before consummation. What decides validity is the conditions of the contract, and not where one happens to be nor the date one picks. This section reports what the fatwa states and adds no condition it does not set.

What is intended: the two of them must be free of impediments, no impediment on the husband's side nor on the wife's side, and it is to be done by the offer and the acceptance, in the presence of two upright witnesses, at the ma'dhoun, or at the judge, or in the wali's house, or in the husband's house.

What we enforce, concretely

The wali is recorded when the sister registers, and receives a link letting him follow the connection from the very first message, without creating an account.

One exchange at a time. As long as a conversation is open, no other can be.

No profile photos, by design. What the fatwas require of the legislated glance is that it happen without seclusion, in the presence of the family or of other people. We draw our own rule from that: a gallery open to all is not that setting. What the platform holds to is narrower still, that of the mouqabalah, in the presence of the guardian or a mahram.

Every message goes past a human moderator before it is delivered.

Frequently asked questions

Is a marriage concluded without a wali valid?

No. The guardian is a condition of the contract's validity, not an option left to families' discretion. A contract concluded without him is declared void according to the majority of the people of knowledge.

Is the marriage contract valid if it has not been registered with an administration?

What makes the contract valid is its conditions, and the place where it is concluded is not one of them: fatwa no. 15986 names the offer, the acceptance and two upright witnesses, and allows the contract at the judge's or in any place. Those conditions are set out, fatwa by fatwa, on the page "What makes a nikah valid". This answer goes no further than what the Shaykh states.

What is the correct amount for a dowry?

No amount is fixed. Fatwa no. 12823 reports that the legislation determined nothing and left people to what they agree on, little or much, while encouraging them to reduce and to make it easy: the best of dowries is the lightest. Not what the family practises, not what a cousin obtained, not what other people's eyes expect.

Can you talk before marriage?

Yes, within a framework. Exchange with a view to marriage is legitimate; being alone together is not. Keeping the guardian informed from the first message, and not letting the conversation drag on without a horizon, are the rules this platform adds so that the line holds.

Is a civil marriage needed as well?

The Islamic contract and civil marriage belong to two different orders. What makes the contract valid is its conditions, and none of the fatwas this page follows deals with civil marriage. This answer therefore stops where they stop: on anything touching procedures, the question is one for people of knowledge.

Is registration paid?

It is entirely free for sisters. Brothers take out a subscription in order to initiate a connection.
