The word is spelled in several ways, hlel, hlal, halal, and comes from the Maghrebi pronunciation of halal, "licit". "Doing the hlel", in the everyday speech of French-speaking Muslims, means concluding the religious marriage: the nikah. Behind the familiar expression there is therefore a precise contract, with precise conditions. Here is what they are, reported from the fatwas of Shaykh Abd al-Aziz Ibn Baz, quoted with their links.
What "doing the hlel" concretely means
Asked about the marriage contract, Shaykh Ibn Baz sums it up this way:
"Marriage brings together four people: the wali, the husband and the two witnesses. That is the legislated marriage."
The hlel is therefore neither a blessing nor a matter of atmosphere: it is a contract concluded by the woman's guardian, with her consent, accepted by the husband, before two witnesses. The detail of each condition, with its fatwa, is in the conditions of marriage in Islam.
Before the hlel: what the period does not allow
This is the part that the phrase "getting into hlel" sometimes makes people forget: as long as the contract is not concluded, the status between the two does not change, and the proposal does not open what only the contract opens. On the period of the khitbah, the marriage proposal, Shaykh Ibn Baz answers:
"The sunnah is that he look at her if that is possible, but without khalwa, rather in the presence of her father, her brother, her mother, or other people. What is intended is that he not be alone with her."
In the same fatwa, asked about the length of the engagement, he answers that it has no known limit, but that during all that time he is not permitted to be alone with her, nor may she ride in a car with him, nor may he travel with her. In other words, it is the contract that changes the status, not the proposal, nor the promise, nor the passing of time. That is exactly what the mouqabalah frames.
The hlel depends neither on a place nor on a date
Can the hlel be done early, long before the celebration? Asked about when the contract is written, the Shaykh answers:
"The contract is permitted at any moment, even long before the wedding, even long before the consummation. And there is no need to join hands, that is not legislated."
The same fatwa specifies that the contract can be concluded at the madhun's, at the judge's, or in any place, in the presence of two upright witnesses. What makes the hlel valid are its conditions, not the place where it is pronounced nor the date chosen for it.
A hlel is not kept secret
Doing the hlel discreetly, among a few people, without telling the families or those around? On the announcement of the marriage, the Shaykh's answer is clear:
"Making the marriage public is obligatory, so that it be distinguished and not be fornication; making it public and announcing it by giving a walimah."
